Please read this End-User License Agreement carefully before clicking the “I Agree” button, downloading or using PetScanner application or the PetScanner microchip reader.
By clicking the “I Agree” button, downloading or using the application, you are agreeing to be bound by the terms and conditions of this agreement.
If you do not agree to the terms of this agreement, do not click on the “I Agree” button and do not download or use the application.
1. License Grant and Restrictions on Use
1.1. License Grant
PetScanner Ltd grants you a revocable, non-exclusive, non-transferable, limited license to download, install and use the application solely for your personal, non-commercial purposes strictly in accordance with the terms of this agreement.
1.2. Restrictions on Use
You agree not to, and you will not permit others to:
a) license, sell, rent, lease, assign, distribute, transmit, host, outsource, disclose or otherwise commercially exploit the application or make the application available to any third party;
b) decompile, reverse engineer, attempt to derive the source of code of or decrypt the application;
c) violate any applicable laws, rules or regulations in connection with your access or use of the application
d) make any modification, improvement, enhancement, translation, adaptation or derivative work from the application;
e) use the application for any revenue generating work, commercial enterprise or other purpose for which it is not designed or intended;
f) use the application for creating a product, service or software that is, directly or indirectly, competitive with or in any way a substitute for any services, product or software offered by PetScanner Ltd.
g) Use any proprietary information or interfaces of PetScanner or other intellectual property of PetScanner in the design, development, manufacture, licensing or distribution of any applications, accessories or devices for use within the application.
2. Modifications to Application
PetScanner Ltd reserves the right to modify, suspend or discontinue, temporarily or permanently, the application or any service to which it connects, with or without notice and without liability to you.
3. Use of Information
3.1. Consent to use information
You hereby authorize and consent to the collection, storage and use, by PetScanner Ltd and its affiliates, partners and agents, of any information and data related to or derived from your use of the application, and any information or data that you provide to PetScanner Ltd and its affiliates, partners and licensors. The Information will be treated as being non-confidential and non-proprietary, and PetScanner Ltd assumes no obligation to protect confidential or proprietary information (other than personally identifiable information) from disclosure and will be free to reproduce, use, and distribute the Information to others without restriction. We will also be free to use any ideas, concepts, know-how or techniques contained in the Information for any purpose whatsoever including, without limitation, developing, manufacturing and marketing products and services incorporating such information.
Personal details (your name, contact number, GPS location and your pet’s name) may be shared with other PetScanner users to improve the features and usage of the app.
3.2. Retention Period of Information
We will retain all registered data for a period of 30 years from the registration date of your most recent registered pet, this is to comply with various pet microchipping legislations, including the Microchipping of Dogs (Scotland) Regulations 2016.
3.3. Location
You authorise that your GPS location is acknowledged in order for PetScanner to generate notifications to the correct list of users, depending on location of the user’s smartphone and location settings on the application.
4. Third Party Content and Services
You acknowledge that the application permits access to products, services, web-sites, advertisements, promotions, recommendations, advice, information, and materials created and provided by advertisers, publishers, content partners, marketing agents, vendors and other third parties (“Third Party Content and Services”).
4.1. Disclaimer
You acknowledge that PetScanner Ltd does not investigate, monitor, represent or endorse the Third-Party Content and Services (including any third party websites available through the application). Furthermore, your access to and use of the Third Party Content and Services is at your sole discretion and risk, and PetScanner Ltd and its affiliates, partners, suppliers and licensors shall have no liability to you arising out of or in connection with your access to and use of the Third Party Content and Services. PetScanner Ltd hereby disclaims any representation, warranty or guaranty regarding the Third-Party Content and Services, whether express, implied or statutory, including, without limitation, the implied warranties of merchantability or fitness for a particular purpose, and any representation, warranty or guaranty regarding the availability, quality, reliability, features, appropriates, accuracy, completeness, or legality of the Third Party Content and Services.
4.2. Endorsements
You acknowledge and agree that the provision of access to any Third Party Content and Service shall not constitute or imply any endorsement by PetScanner Ltd or its affiliates of such Third Party Content and Services. PetScanner Ltd reserves the right to restrict or deny access to any Third Party Content and Services otherwise accessible through the application, although PetScanner Ltd has no obligation to restrict or deny access even if requested by you.
5. Infringement Acknowledgment
You and PetScanner Ltd acknowledge and agree that, in the event of a third party claim that the application or your possession or use of the application infringes any third party’s intellectual property rights, you (and not PetScanner Ltd) will be responsible for the investigation, defence, settlement and discharge of any such claim of intellectual property infringement. You will, however, promptly notify PetScanner Ltd in writing of such a claim.
6. Term and Termination
This Agreement shall remain in effect until terminated by you or PetScanner.
PetScanner Ltd may, in its sole discretion, at any time and for any or no reason, suspend or terminate this Agreement with or without prior notice.
This Agreement will terminate immediately, without prior notice from PetScanner Ltd, in the event that you fail to comply with any provision of this Agreement. You may also terminate this Agreement by deleting the application and all copies thereof from your mobile device or from your desktop. Upon termination of this Agreement, you shall cease all use of the application and delete all copies of the application from your mobile device or from your desktop.
7. Disclaimer of Warranties
You acknowledge and agree that the application is provided on an “as is’ and “as available” basis, and that your use of or reliance upon the application and any third party content and services accessed thereby is at your sole risk and discretion. PetScanner Ltd and its affiliates, partners, suppliers and licensors hereby disclaim any and all representations, warranties and guaranties regarding the application and third party content and services, whether express, implied or statutory, and including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Furthermore, PetScanner Ltd and its affiliates, partners, suppliers and licensors make no warranty that (i) the application or third party content and services will meet your requirements; (ii) the application or third party content and services will be uninterrupted, accurate, reliable, timely, secure or error-free; (iii) the quality of any products, services, information or other material accessed or obtained by you through the application will be as represented or meet your expectations; or (iv) any errors in the application or third party content and services will be corrected. No advice or information, whether oral or written, obtained by you from PetScanner Ltd or from the application shall create any representation, warranty or guaranty. Furthermore, you acknowledge that PetScanner Ltd has no obligation to correct any errors or otherwise support or maintain the application.
8. Application Updates
We may be required to update the PetScanner application at any time in order to better the quality and features of the app, in which case we may suspend access to the application or close it indefinitely.
9. Limitation of Liability
You expressly understand and agree that under no circumstances shall PetScanner Ltd or its affiliates, partners, suppliers or licensors be liable for any indirect, incidental, consequential, special or exemplary damages arising out of or in connection with your access or use of or inability to access or use the application or PetScanner device/microchip reader, including any loss of data or damage to your mobile device, whether or not PetScanner Ltd or its representatives have been advised of or should have been aware of the possibility of any such losses arising.
10. Compatibility
PetScanner Ltd does not warrant that the application will be compatible interoperable with your Mobile Device or any other piece of hardware, software, equipment or device installed on or used in connection with your Mobile Device. Furthermore, you acknowledge that compatibility problems can cause the performance of your Mobile Device to diminish or fail completely, and may result in permanent damage to your mobile device, loss of the data located on your Mobile Device, and corruption of the software and files located on your mobile device. You acknowledge and agree PetScanner and its affiliates, partners, suppliers and licensors shall have no liability to you for any losses suffered resulting from or arising in connection with compatibility or interoperability problems.
11. Severability
If any provision of this License is held to be invalid or unenforceable with respect to a party, the remainder of this License, or the application of such provision to persons other than those to whom it is held invalid or unenforceable shall not be affected and each remaining provision of this License shall be valid and enforceable to the fullest extent permitted by law.
12. Amendments to this Agreement
PetScanner Ltd reserves the right, at its sole discretion, to modify this Agreement at any time. If a revision is material we will provide at least 14 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
